DescriptionAn Ohio judge denied a late push by the state's governor, its top election official and voters to delay Tuesday's primary amid the coronavirus pandemic.

Ohio Gov. Mike DeWine announced earlier Monday that the state would support a lawsuit to delay voting. "We can't tell people it's in their best interest to stay home and at the same time tell people to go vote," DeWine said at a news conference. But Judge Richard Frye ruled later that evening that it was too late to move back the primary.

Frye also took issue with the state’s claim that moving the election to June would alleviate voters’ health concerns, saying there's no medical evidence the pandemic will have disappeared by then.


“We’re here at 7 o’clock, 12 hours before the election. I don’t believe the plaintiffs have proceeded in a timely manner,” Frye said. “And for that matter, I don’t believe the Secretary of State has proceeded in a timely manner himself.”

“There is no medical evidence here today to suggest that” it would be safer to vote in June, Frye added. “To the contrary, it’s my understanding from the briefings we’ve seen in the national media that it may be months before we get to a point of stability or a peak of the virus and its transmission rates.”

Marshall infuriated Jackson by insisting that Georgia laws that purported to seize Cherokee lands on which gold had been found violated federal treaties. Jackson is famous for having responded: "John Marshall has made his decision, now let him enforce it." Although the comment is probably apocryphal, both Georgia and Jackson simply ignored the decision.

I have mixed feelings about this. It’s the right thing to do given the health situation.

But isn’t it also dangerous for the Executive Branch to overrule the Judicial branch?

Seems like a separation of powers issue and I’m concerned about implications on the federal level.
