| Description | NEW ORLEANS -- The federal appeals court in New Orleans said Louisiana must put both fathers' names on the revised birth certificate of a boy adopted by a same-sex couple.
The 5th U.S. Circuit Court of Appeals ruled Thursday in a lawsuit brought by Oren Adar and Mickey Ray Smith of San Diego, whose son was born in Shreveport in late 2005 and adopted in New York State on April 27, 2006.
It upheld a district judge's ruling and ordered the state to "forthwith" create a new birth certificate for the child, identified as "Infant J".
Neither attorney Kenneth Upton, who represents the couple, nor Louisiana Attorney General Buddy Caldwell could be reached immediately for comment.
State attorneys contended that since unmarried couples cannot adopt in Louisiana, only one name could be on the certificate. |
