Precedent certainly is not a "garbage argument." But it is only one argument.
And WA Indy, I think our disconnect is which part of Cornyn's tweet we each focused on. I focused more on the first clause and you focused more on the latter parts. Cornyn has since tweeted some clarifications and I'm sure he (or more likely the staffer who tweets) didn't intend it the way some are taking it, but he probably should have worded it more clearly the first time around.
