DescriptionCLEVELAND, Ohio -- A man who was found guilty for murdering a Garfield Heights man and a police sergeant from that city in 1994 is back on death row after a ruling Monday by the U.S. Supreme Court.

Cuyahoga County Prosecutor Bill Mason said he will now ask the Ohio Supreme Court to set an execution date for Harry Mitts.

"He has exhausted his appeals and should be executed," Mason said in a news release.

In 1994, Mitts fatally shot John Bryant, his neighbor near his Garfield Heights apartment building. Bryant, who was black, was shot in the chest near East 88th Street. Authorities said that the murder was racially motivated.

When Garfield Heights and Maple Heights police were called to Mitts' apartment to investigate the murder, Mitts got into a shoot out with the officers.

Mitts killed Garfield Heights Police Sgt. Dennis Glivar and wounded Garfield Heights Lt. Thomas Kaiser and Maple Heights Patrolman John Mackey.
