DescriptionBrooklyn State Senator Kevin Parker was acquitted by a jury Tuesday of felony assault charges in connection with an attack on a New York Post photographer in May 2009.

The jury did find him guilty of two counts of criminal mischief.

That conviction does not require expulsion from the State Senate, but carries a penalty of up to two years behind bars.

"It's not quite the determination that I was hoping for. I've always maintained my innocence. The jury didn't quite see it the way I did," Parker told reporters.

"The jury heard all of the evidence in this case, reviewed all the exhibits and made the determination that they felt was appropriate," said Prosecutor Kathleen DiGiovanni.

The case stemmed from an altercation last year near Parker's Flatbush home. A photographer who was working on a story about Parker's financial problems broke his finger and damaged his camera when he got into a scuffle with Parker.

Jurors, however, found the lawmaker never intentionally assaulted him. They say prosecutors also couldn't prove the camera was as expensive as they claimed, which would have made the crime more serious.
