Description"State Rep. Paul Costa was cited for smoking a marijuana cigarette near Heinz Field on a Pittsburgh Steelers game day last month.

The Allegheny County District Attorney's Office said Tuesday that Costa has a court date next week in connection with his citation from Oct. 3, when the Steelers played the Baltimore Ravens.

Channel 4 Action News' Ari Hait reported that many people were tailgating in the parking lots along Tony Dorsett Drive before the game. According to the criminal complaint, police officers said they saw Costa with another man, “smoking and passing between them a hand-rolled white cigarette (and) could smell the overpowering scent of burning marijuana.”

Costa's lawyer, Phil DiLucente, told Channel 4 Action News that Costa "did not have any marijuana on his person, nor was he smoking any."

Costa was not available for comment, but he looks forward to fighting his citation in court, DiLucente said.

“I think this is, quite frankly, outrageous. He (Costa) adamantly denies ever touching marijuana. In fact, he detests it,” said DiLucente.

According to the criminal complaint, Costa and the other man were approached by police and “dropped the marijuana cigarette onto the ground where they both stated without being asked, ‘You got us.’”

DiLucente said those words were never spoken. His theory is that Costa, like many other fans, was wearing a Steelers jersey and police just got the wrong guy."
