Description"There seems to be a dispute brewing over when Colorado’s new U.S. senator would take his seat, at least if Republican Ken Buck beats incumbent Sen. Michael Bennet in November.

State officials tell Washington Wire the new senator would be sworn in on Jan. 3, with the new Congress. But Republican officials say the state law indicates that Bennet’s term, since he was appointed to fill a vacancy, should actually end immediately after the election.

“We’re aware of the rules, and we don’t expect Democrats to try to play any reindeer games,” a senior GOP Senate leadership aide said. “We believe that once they have a signed election certificate, they’ll be seated.”

The difference of opinion is reminiscent of the January election win by GOP Sen. Scott Brown in Massachusetts, when Republicans feared the Democratic-run state government would delay seating Brown until after the passage of President Barack Obama’s health care overhaul.

The stakes are lower this time, since the seat would be in dispute only for a lame-duck session in which the GOP already has the votes to block Democratic initiatives.

But the plot could thicken if the seating disputes spread to other states. There are four other Democratic appointees in the Senate whose seats are up for election – from Delaware, Illinois, West Virginia, and New York – and Republicans stand a good chance of winning in Delaware and Illinois."
