Description | Tennessee Atty. Gen. Robert E. Cooper says the state legislature’s attempts to nullify the federal health insurance reform act are likely unconstitutional themselves – and as a result, his office could not attempt to enforce the legislature’s efforts.
Unlike his counterparts in nearly two dozen other states who have filed suit challenging the federal act in the courts, Cooper’s new advisory opinion issued today makes clear that if the state legislature wants to challenge the reforms, the legislature will have to hire its own lawyer and appropriate the money to pay for it. |
