"Rick Santorum's vote in Penn Hills will count, at least this time, but the former senator's standing as an elector in the community he still calls home could have changed once he left Congress.

Yesterday, after a 15-minute hearing, county election officials ruled against a Penn Hills Democratic committeeman who challenged absentee ballots cast by Mr. Santorum and his wife, Karen, on Nov. 4.

They said Ed Vecchio failed to make his case that the couple does not legally reside at a home they own on Stephens Lane.

"Our decision is that you didn't produce enough evidence here," elections director Mark Wolosik said.

Whether a case could be made remains unclear, but one authority on election law said the law would appear to argue that the Santorums are no longer entitled to vote from that residence because they no longer use it as their home.

"The way the election code reads and case law reads, residence for purpose of voting, is the equivalent of domicile. It's the place to which you return," said Ralph J. Teti, a Philadelphia attorney who wrote a chapter on voter eligibility in a book on state election laws.

Individual states establish their own standards for voting eligibility and federal law adds an additional twist.

Under federal statute, anyone who leaves a state for federal service is permitted to retain a state address, a move that allows members of the military to vote by absentee ballot and federal employees, including elected officials, to maintain their residence."
