"Another new name has surfaced as a possible fill-in for Sen. Joe Biden's term if he gets elected vice president next month.

State Supreme Court Chief Justice Myron Steele joins a list that includes Minner administration insider Bob Byrd & Secretary of State Harriet Smith Windsor. That, of course, also assumes Biden wins an unprecedented seventh term in the Senate with little campaigning.

Steele would be an excellent choice for more than one reason. He's a respected veteran jurist and lawyer who has had his share of political seasoning as a former Kent County Democratic Party chairman. He's from Gov. Ruth Ann Minner's home county, and she appointed him chief justice.

Two years from now, he would be 65 and ready to retire to his farm with a good-sized state pension. And he wouldn't likely be one to change his mind and run for the remainder of the four-year Senate term in 2010.

A usually reliable Democratic Party source also said that Biden has signed off on Steele as a possible replacement if all the moons line up.

I've also been told that Minner's office has received a ruling from the attorney general's office that it would be the incoming governor -- not the outgoing incumbent -- who would make the appointment to fill Biden's vacant U.S. Senate seat.

I'm not sure I buy that, even if the attorney ruled that way, since the state Constitution is silent on the time of day the governor gets sworn in. I don't see anything that would prohibit the sitting governor, no matter how many hours she has left in her term. For that matter she could appoint a replacement as soon as Biden resigns his Senate seat. That could be the day after he's elected veep and would give Steele, or whoever, an extra couple months of seniority when they are sworn in.

It's generally agreed by all Democrats that AG Beau Biden, who's going to be serving a year's tour in Iraq with the Army National Guard, would not seek his his father's seat until 2010."
