Description(New York City) New York Attorney General Eliot Spitzer has become the first candidate for governor in the history of the Empire State to publicly endorse same-sex marriage - even though he is currently in court defending a state law banning gay unions.

Spitzer is the frontrunner in the race for the Democratic nod for governor. His expected running mate, Senate Minority Leader David Paterson also supports same-sex marriage as do all six people seeking the Democratic nomination for Attorney General and state Comptroller Alan G. Hevesi, also a Democrat.

They are all among more than 40 elected officials across NY state who have signed onto an initiative by Empire State Pride Agenda - New York's LGBT rights group - called New Yorkers for the Freedom to Marry.

"We are proud that elected officials all across the state are joining clergy members in standing up for our families and for a New York where all people are treated equally under the law,” said Alan Van Capelle, Executive Director of Pride Agenda.

"When same-sex couples are able to marry and government provides our families the same protections and support it provides to all other families, these elected officials will be seen as being on the right side of history."

Tom Suozzi, Spitzer's Democratic rival, opposes same-sex marriage but supports domestic-partner benefits.

Republicans scoffed at Spitzer's support for equal marriage rights.
