FRANKFORT, Ky. - Three top Transportation Cabinet officials were indicted Tuesday, the first charges from the continuing investigation of improper political influence in Fletcher administration personnel practices.
A Franklin County special grand jury indicted acting Secretary Bill Nighbert, Deputy Secretary Jim Adams and Commissioner Dan Druen on misdemeanor charges of political discrimination, official misconduct and criminal conspiracy.
The charges all arise from the dismissal of Mike Duncan as deputy inspector general in the cabinet, an ironic twist because the inspector general's office was going to look into personnel practices until it was pulled off by Nighbert.
Duncan, who appeared before the grand jury last week, was fired over the objection of Inspector General David Ray. The indictment alleges that Duncan was fired "based on his political affiliation or opinion."
Transportation officials had said Duncan didn't complete a six-month probationary period as a Merit System employee, but the indictment said the probation period was completed when Duncan was fired.
Republican Gov. Ernie Fletcher has criticized the investigation, led by Attorney General Greg Stumbo, claiming it has been politically motivated. Stumbo, a Democrat and a potential rival in the 2007 governor's race, has said he is only investigating criminal allegations brought to him by a whistleblower in the cabinet. |
