Nicholas Ferraro, a former State Senator, District Attorney and State Supreme Court justice, died Friday at the City Hospital Center in Elmhurst, Queens, shortly after suffering a heart attack at his home. He was 56 years old and lived in Jackson Heights, Queens.
Mr. Ferraro was a cousin of Representative Geraldine A. Ferraro, the Democratic Vice-Presidential candidate this year. He gave Mrs. Ferraro a job as a lawyer in his office when he was Queens District Attorney in 1974.
Mr. Ferraro lived his entire life in the neighboring Astoria and Jackson Heights sections. Last April, he resigned as a State Supreme Court justice to resume private law practice.
Born in Astoria, he graduated from Seton Hall College and earned his law degree in 1953 from the Brooklyn Law School. In Legislature 8 Years
After starting his own law practice, he joined the Tamiment Democratic Club in Queens and, in 1957, was appointed an assistant district attorney under District Attorney Frank D. O'Connor.
Eight years later, in 1965, he was elected to the State Senate as a Democrat from Queens. He remained a legislator for eight years.
In 1973, with the backing of Matthew J. Troy Jr., who was then a City Councilman and the Queens County Democratic leader, Mr. Ferraro ran successfully for District Attorney in the borough.
Three years later, Mr. Ferraro, as the District Attorney, was involved in an investigation of charges of fraud against Mr. Troy. Mr. Troy later pleaded guilty to state charges of grand larceny and Federal charges of tax evasion and served brief prison terms. Other well-publicized cases investigated by Mr. Ferraro's office were the finances of the Hare Krishna religious movement, welfare fraud and a fatal explosion at a Queens chewing-gum factory. Mr. Ferraro was District Attorney until November 1976, when, with the backing of the Democratic, Republican and Liberal Parties, he was elected to the State Supreme Court in Queens.
Donald R. Manes, the Queens Borough President, said Mr. Ferraro had served his borough and state ''ably, effectively and responsibly'' during his 19 years in elected office.
Mr. Ferraro is survived by his wife, Virginia; his mother, Antonetta, of Jackson Heights; a brother, Carl, of Jackson Heights; a daughter, Linda Dawson, of Greenlawn, L.I.; two sons, Nicholas Jr. and Ronald, both of Brigantine, N.J., and four grandchildren.
The funeral will be tomorrow at 9:30 A.M. at Our Lady of Fatima Roman Catholic Church, 25-02 82d Street, in Jackson Heights.
