Burton; served from November 6, 1946, until January 3, 1947; was not a candidate for election to the full term; justice of the Ohio Supreme Court 1948-1962, chief justice from 1962 until his death March 28, 1970, in Columbus, Ohio; interment in Lakeview Cemetery, Cleveland, Ohio.
