In June 1976, he was arrested by the Salt Lake City vice squad and accused of soliciting sex acts for hire from two undercover policewomen. After his conviction in City Court for the misdemeanor charge, he appealed the verdict to District Court and again was found guilty. He maintained his innocence.

Rep. Howe lost the 1976 general election to Daniel D. Marriott, a Republican. He then did lobbying work in Washington and until March had spent a decade as Washington representative for the National Park and Hospitality Association, a lobbying group for park concessionaires.
