Description | ST. GEORGE -- A federal judge in Virginia declared President Barack Obama’s health care law unconstitutional Monday, calling the law’s mandate to purchase insurance a step too far for Congressional authority.
Ruling on an issue many believe will ultimately be decided by the U.S. Supreme Court, U.S. District Judge Henry E. Hudson became the first federal judge to strike down the law, which has been upheld by two other federal judges in Virginia and Michigan.
Sen. Orrin Hatch, R-Utah, applauded the decision.
“Today is a great day for liberty,” Hatch said in a statement. “Congress must obey the Constitution rather than make it up as we go along. Liberty requires limits on government and today those limits have been upheld.”
Hatch introduced the American Liberty Restoration Act in June, which would repeal the individual insurance mandate. Fifteen senators have co-sponsored the bill so far. |
