Whitley was born in Rochester, New York. He graduated from the law department of Union College in 1898. He served as a sergeant in the Spanish-American War. He was a member of the New York State Assembly from 1905 until 1910 and the New York State Senate from 1918 until 1928. He was elected to Congress in 1928 and represented New York's 38th congressional district from March 4, 1929 until January 3, 1935. He unsuccessfully ran for re-election against James P.B. Duffy in 1934. He died in Rochester, New York.
